Thanks for making trouble and wasting the time of this small non-profit mostly volunteer run organization (disclaimer: I don't work there).

Based on the litigious tone and information in your post no doubt your calls to the "US Justice Department" will have equal success as your inquires at Internet Archive. If what you said was the case, than every email provider in the world would be illegal since they "knowingly" allow spam to pass through. Internet Archive is not responsible for the content its users upload. If IA was made aware of something illegal, yes, they are responsible to take it down (this would be copyright material for instance). Internet Archive is like Usenet feed providers and phone companies, they are not legally liable for content users upload unless its illegal and someone, such as the copyright holders, makes them aware of it and asks for it to be removed. Seriously, have you ever heard of a website being sued because someone posted spam on it? Ridiculous. It would be open season on lawsuits.
